COLLECTING DONATIONS TO BUILD A MOSQUE AND GIVING ONE OF THE DONORS AN ALL
EXPENSES PAID ‘UMRAH TRIP
Your efforts to build a mosque come
under the heading of righteous deeds. Allah, may He be exalted, says
(interpretation of the meaning):
“The Mosques of Allah shall be
maintained only by those who believe in Allah and the Last Day; perform
As-Salat (Iqamat-as-Salat), and give Zakat and fear none but Allah. It is they
who are expected to be on true guidance”[Holy Quran Chapter at-Tawbah 9:18].
Ibn Maajah (738) narrated from
Jaabir ibn ‘Abdullah (may Allah be pleased with him) that the Messenger of
Allah (blessings and peace of Allah be upon him) said: “Whoever builds a mosque
for the sake of Allah, like a sparrow’s nest or even smaller, Allaah will build
for him a house in Paradise.” Classed as saheeh by al-Albaani.
What is meant in the hadeeth is to
encourage giving even the smallest amount to build a mosque.
The one who participates in or
contributes to building a mosque will have a reward commensurate WITH
HIS/HER CONTRIBUTION.
But the efforts to achieve these
good deeds must be in accordance with Islamic teachings, because Allah is good
and does not accept anything but that which is good.
In the case of this method of Umrah
Trip, in which some people give contributions to building the mosque in the
hope of winning a free ‘Umrah, the one who joins in will either be a winner, if
he wins the ‘Umrah trip, or he will be a loser if someone else wins the prize.
In fact this comes under the heading of gambling which is forbidden in
Islam.
Allah, may He be glorified and
exalted, says (interpretation of the meaning):
“O you who believe! Intoxicants (all
kinds of alcoholic drinks), gambling, Al-Ansab, and Al-Azlam (arrows for
seeking luck or decision) are an abomination of Shaitans (Satan) handiwork. So
avoid (strictly all) that (abomination) in order that you may be successful. Shaitan
(Satan) wants only to excite enmity and hatred between you with intoxicants
(alcoholic drinks) and gambling, and hinder you from the remembrance of Allah
and from As-Salat (the prayer). So, will you not then abstain?[ Holy Quran
Chapter al-Maa’idah 5:90-91].
Moreover, if the donor is hoping to
win this ‘Umrah by means of donating and giving charity, this is a kind of
compensation for his charity which goes against the shar‘i definition of
charity. The Prophet (blessings and peace of Allah be upon him) forbade the
giver to take back his charity or to buy it again, if he finds it being offered
for sale, lest that be a kind of going back on it, and in order to put an end
to attachment in hearts that are naturally inclined towards stinginess to that
which they have given for the sake of Allah. So how about if a person gives his
charity hoping for something like that from the outset?
Hence we advise you not to use this
method of collecting funds for the mosque, and to limit it to encouraging
people to donate on the basis of what Allah has promised of reward in the
hereafter to those who spend and give charity, and on the basis of the reports
that speak the one who builds a mosque, or participates in building it, for the
sake of Allah and seeking reward with Him.
It was narrated that ‘Uthmaan ibn
‘Affaan (may Allah be pleased with him) said: I heard the Messenger of Allah
(blessings and peace of Allah be upon him) say: “Whoever builds a mosque for
the sake of Allah, may He be exalted – Katheer [one of the narrators of the
hadeeth] said: I think he said – seeking thereby the Countenance of Allah,
Allah will build for him a house in Paradise.” Narrated by al-Bukhaari, 450;
Muslim, 1217.

ASKING FOR CHARITY TO BUILD A MOSQUE
Building mosques and helping in that
is one of the greatest of acts of worship before Allah. Participating with
others in building these mosques is the kind of cooperation in righteousness
and piety that is prescribed in Islam.
If that is in a Western country or
any other non-Muslim country, then it is even more important to cooperate in
doing that, because the Muslims there are in great need of that and because it
makes it easier for the people living there to do acts of worship and
encourages people to adhere to the rituals of Islam. And that also often plays
a role in bringing non-believers to the faith. So the Muslims there should
cooperate in such matters, so that their religion will become manifest among
non-Muslims. There is nothing wrong with asking for charity to build a mosque
or other things that the Muslims need, whether they ask in the mosques or in
the marketplaces or any other place where people gather.
It was narrated from Abu Sa‘eed
al-Khudri (may Allah be pleased with him) that the Messenger of Allah
(blessings and peace of Allah be upon him) went out on (Eid) al-Adha or al-Fitr
to the prayer place, and when he had finished praying he exhorted the people
and instructed them to give charity, saying: O people, give charity. Then he
went to the women and said: O women, give charity… Narrated by al-Bukhaari,

But that request for charity should
be done without embarrassing others or putting pressure on them. Rather the
teaching of the Prophet (blessings and peace of Allah be upon him) in such
matters is to call on the people and encourage them to give in general terms,
explaining to them the virtue of participating in that and hastening to do it.
Then they should be left to decide what to do. There is nothing wrong with one
of the people in charge of that making a special request to someone who he has
ties with but, as we said, that should be done without embarrassing him or
putting pressure on him or causing any hardship.
Shaykh Ibn Baaz (may Allah have
mercy on him) was asked: We have a charitable fund for the mosque and there is
a man who is allocated to looking after this fund; he takes the collection box
around the rows of worshippers before the prayer begins, especially on Fridays.
What is the ruling on doing this, especially since some of the worshippers feel
somewhat embarrassed?
He replied: It depends, because what
is meant is that he is asking of the worshippers and that may embarrass or
annoy them. If he refrains from going around among them and asking them to put
some money in this box for the mosque, that would be better. Otherwise the matter
is broad in scope. If the imam says: The mosque needs your help, there is
nothing wrong with that, because this is a charitable project. But taking the
box around among their rows may cause some annoyance or embarrassment. So
what I think is that it is better not to do that and just to announce that this
box is for the mosque and whoever wants to may put something in it. You should
not take it around among them or annoy them by doing so. This is more on the
safe side and is a sounder practice.

HOW ABOUT SOME ONE WHO MADE A BEQUEST OF SOME MONEY AS A CONTRIBUTION TO
BUILDING A MOSQUE; CAN THE EXECUTOR OF THE BEQUEST GIVE IT TO THE POOR BECAUSE
THEY ARE IN NEED?
POSSIBLE ANSWERS:
Building mosques, maintaining them
and preparing them for the worshippers is one of the best of good and righteous
deeds for which Allah has decreed an immense reward. It comes under the heading
of ongoing charity (sadaqah jaariyah) which will continue to bring reward even
after a person’s death. Allah, may He be exalted, says (interpretation of the
meaning):
“The Mosques of Allah shall be
maintained only by those who believe in Allah and the Last Day; perform
As-Salat (Iqamat-as-Salat), and give Zakat and fear none but Allah. It is they
who are expected to be on true guidance”[ Holy Quran Chapter at-Tawbah 9:18].
The Prophet (blessings and peace of
Allah be upon him) said: “Whoever builds a mosque, Allah will build for him a
house in Paradise.” Narrated by al-Bukhaari (450) and Muslim (533), from the hadith
of ‘Uthmaan (may Allah be pleased with him).
The basic principle is that it is
obligatory to carry out the wishes of the one who left that endowment (waqf),
and it was narrated that there was scholarly consensus on this point in general
terms.
Al-Hajjaawi (may Allah have mercy on
him) said in Zaad al-Mustaqni‘: It is obligatory to carry out the wishes
of the one who made the endowment.
Shaykh Muhammad al-Mukhtaar
ash-Shanqeeti (may Allah preserve him) said: That is, it is obligatory upon the
one who has been appointed to look after the endowment to act in accordance
with the wishes stipulated by the one who made that endowment.
If the one who made the endowment
stipulated conditions, or it set out specific signs or characteristics to
determine who is entitled to benefit from his endowment, then it is obligatory
to act accordingly, and it is not permissible to ignore these conditions or
tamper with them. That is according to the consensus of the scholars, may Allah
have mercy on them. When ‘Umar ibn al-Khattaab (may Allah be pleased with him)
wrote his will, in which he left his land in Khaybar as an endowment (waqf), he
entrusted supervision of it to the Mother of the Believers Hafsah (may Allah be
pleased with her), then after her to the most mature and just of his
descendants, and he stipulated conditions on how the income from the endowment
was to be spent and used. The practice among the leading scholars and judges of
the Muslims has been that the wishes of the one who left the endowment should
be followed and it is not permissible to cancel them, alter them, change them
or distort them.
Hence the author said “it is
obligatory”, which indicates that the one who goes against that is sinning.
Hence it is not permissible to alter these instructions, unless the QAADI
determines otherwise in exceptional circumstances, which we will
explain below, in sha Allah. However the basic principle remains that it is
obligatory to act in accordance with these instructions and carry them out, and
the conditions may vary. If a person leaves a piece of land or anything else as
an endowment, he may stipulate that it is to be cared for by a particular
individual, or he may stipulate a particular beneficiary for the endowment, or
he may stipulate that this beneficiary should have certain characteristics.End
quote from Sharh az-Zaad.
To sum up: It is not
permissible to transfer the endowment to someone else, or to change the
instructions of the one who made the endowment, unless it is no longer possible
to carry out the terms of the endowment as stipulated.
Based on that, what you must do is
act in accordance with your RELATIVES’s
wishes, in compliance with the shar‘i texts to that effect, as mentioned
above. Even those scholars who say that it is permissible to change the
endowment or change its conditions meant that that applies only if it is better
for the endowment and will enable people to benefit from it more completely,
and there is no interest to be served by changing or annulling the
endowment.
