WHY OUR DUAAS ARE NOT ANSWERED BY ALLAAH & ALSO DELAYED THE RESPONSE TO DU’AA’?

In the name of Allah, the Beneficent, the Merciful

We thank and praise Allah SWT, the Compassionate, and the Merciful. We bear witness that there is no one worthy of worship except Allah…Who is so near to all of us and so ready to respond to our pleas for help and guidance. We bear witness that our beloved Prophet Muhammad (sallAllahu alyhi wasallam) is the true and the last Messenger of Allah, who called on Allah (Subhanahu Wa Taala) night and day in his salaah (prayer) and in humble supplications (du’ahs) appealed for guidance. O Allah, shower your choicest blessings on him, his friends and relatives, all those who, through their fear of Allah, their love and their total dependence on Him, spent their time in the remembrance of Allah and beseeching Allah to accept their efforts in life.

This article is on why doesn’t Allaah answer our Duaas and does Allaah delay the response to Du’aa’ for the one whom He loves? Included is small medium frauds (big ones not stated here) and haram which affect our Aduas with special reference to Nigeria.

SECTION 1: WHY OUR DUAAS ARE NOT ANSWERED BY ALLAAH?

It is reported that Ibrâhîm b. Adham (d162H) – Allâh have mercy on him – once passed through the market of Basrah. People gathered around him and asked:

O Abû Ishâq, Allâh the Exalted says in his Book. ‘Call on me, I will answer your prayers’, but we have been calling on Him for a long time and He does not answer our prayers.
[Ibrâhîm] replied, “O people of Basrah, your hearts have died in respect to ten things:

1)      First, you know Allâh; but you do not give Him His rights;

2)      Second, you have read Allâh’s Book; but you do not act by it;

3)      Third, you claim to love Allâh’s Messenger – Allâh’s (peace and blessings be upon him); yet you abandon his Sunnah;

4)      Fourth, you claim to be enemies to Shaytân; but you conform to [his ways];

5)      Fifth, you say you love Paradise yet you do not work for it;

6)      Sixth, you say you fear The Fire; yet you put yourselves closer to it [by sinning];

7)      Seventh, you say death is true; but you do not prepare for it;

8)      Eighth, you busy yourselves with the faults of others; and disregard your own;

9)      Ninth, you consume the favors of your Lord; but are not grateful for them; and

10)   Tenth, you bury your dead; but take no lesson from them.”

THINGS WHICH MAY PREVENT DU’AA’ FROM BEING ANSWERED

1. When the du’aa’ is weak in itself, because it involves something inappropriate, or involves bad manners towards Allaah, may He be exalted, or it is inappropriate, which means asking Allaah for something which it is not permitted to ask, e.g. when a man asks to live forever in this world, or he asks for a sin or something haraam, or he prays that he will die, and so on. Abu Hurayrah (may Allaah be pleased with him) said: The Messenger of Allaah (peace and blessings of Allaah be upon him) said: “A person's du’aa’s will continue to be answered so long as he does not pray for something sinful or for the breaking of family ties.” Narrated by Muslim.

2. When the person who is making du’aa’ is weak in himself, because he is faint-hearted in his turning towards Allaah. This may be either because of bad manners towards Allaah, may He be exalted – such as raising his voice in du’aa’ or making du’aa’ in the manner of one who thinks he has no need of Allaah; or because he pays too much attention to the wording and tries to come up with unnecessarily ornate phrases, without paying attention to the meaning; or because he tries too hard to weep or shout without really feeling it, or he goes to extremes in that.

3. The reason why his du’aa’ is not answered may be because he has done something that Allaah has forbidden, such as having haraam wealth – whether it be food or drink or clothing or accommodation or transportation, or he has taken a haraam job, or the stain of sin is still in his heart, or he is following bid’ah (innovation) in religion, or his heart has been overtaken by negligence.

4. Consuming haraam wealth. This is one of the major reasons why du’aa’s are not answered. Abu Hurayrah (may Allaah be pleased with him) said: the Messenger of Allaah (peace and blessings of Allaah be upon him) said: “O people, Allaah is Good and only accepts that which is good. Allaah commanded the pious to follow the same commandments as He gave to the Messengers. He says (interpretation of the meaning): ‘O (you) Messengers! Eat of the Tayyibaat [all kinds of Halaal (lawful) foods which Allaah has made lawful (meat of slaughtered eatable animals, milk products, fats, vegetables, fruits)] and do righteous deeds. Verily, I am Well-Acquainted with what you do’ [Holy Quran Chapter al-Mu’minoon 23:51].

‘O you who believe (in the Oneness of Allaah — Islamic Monotheism)! Eat of the lawful things that We have provided you with’ [Holy Quran Chapter al-Baqarah 2:172]

Then he mentioned a man who has travelled on a long journey and is dishevelled and covered with dust; he stretches forth his hands to the heaven, (saying) “O Lord, O Lord”, but his food is haraam, his drink is haraam, all his nourishment is haraam, so how can he du’aa’ be accepted?” Narrated by Muslim.

The man described by the Prophet (peace and blessings of Allaah be upon him) had some of the characteristics which help du’aa’s to be answered – he was travelling and he was in need of Allaah, may He be exalted and glorified – but the fact that he consumed haraam wealth prevented his du’aa’ from being answered. We ask Allaah to keep us safe and sound.

5. Trying to hasten the response. Abu Hurayrah (may Allaah be pleased with him) said: the Messenger of Allaah (peace and blessings of Allaah be upon him) said: “The du’aa’ of any one of you will be answered so long as he is not impatient and says, ‘I made du’aa’ but it was not answered.’” Narrated by al-Bukhaari and Muslim.

6. Making the du’aa’ conditional, such as saying, “O Allaah, forgive me if You will” or “O Allaah, have mercy upon me if You will.” The person who makes du’aa’ has to be resolute in his supplication, striving hard and earnestly repeating his du’aa’. The Prophet (peace and blessings of Allaah be upon him) said: “Let not any one of you say, ‘O Allaah, forgive me if You will, O Allaah, have mercy on me if You will.’ Let him be resolute in the matter, whilst knowing that no one can compel Allaah to do anything.” Narrated by al-Bukhaari and Muslim.

In order for du’aa’s to be answered, it is not essential to adhere to all of these points and be free of all that could prevent one’s du’aa’s from being answered. That is something which happens very rarely. But one has to try hard and strive towards achieving this.

Another important point is to realize that the response to the du’aa’ may take different forms: either Allaah will respond and fulfil the desire of the person who made the du’aa’, or He will ward off some evil from him because of the du’aa’, or He will make something good easy for him to attain because of it, or He will save it with Him for him on the Day of Resurrection when he will be most in need of it.

SECTION 2. ETIQUETTE AND RULINGS OF ANSWERING PRAYERS (ADUAS)

Imaam Ibn al-Qayyim (may Allaah have mercy on him) said: “Du’aa’s and ta’awwudhaat [prayers seeking refuge with Allaah] are like a weapon, and a weapon is only as good as the person who is using it; it is not merely the matter of how sharp it is. If the weapon is perfect and free of faults, and the arm of the person using it is strong, and there is nothing stopping him, then he can lay waste the enemy. But if any of these three features is lacking, then the effect will be lacking accordingly.” (al-Daa’ wa’l-Dawaa’, p. 35).

From this it will be clear that there is an etiquette and rulings which must be fulfilled, in the du’aa’ and in the person making the du’aa’. There are also things that may prevent the du’aa’ reaching Allaah or being answered – these things must be removed from the person making the du’aa’ and from the du’aa’. When all of these conditions are fulfilled, then the du’aa’ may be answered.

1. Sincerity in making du’aa’. This is the most important condition. Allaah has commanded us to be sincere when making du’aa’, as He says (interpretation of the meaning): “So, call you (O Muhammad and the believers) upon (or invoke) Allaah making (your) worship pure for Him (Alone) (by worshipping none but Him and by doing religious deeds sincerely for Allaah’s sake only and not to show off and not to set up rivals with Him in worship)” [Holy Quran Chapter Ghaafir 40:14].

Sincerity in du’aa’ means having the firm belief that the One upon Whom you are calling – Allaah, may He be glorified and exalted – is alone Able to meet your need, and it also means avoiding any kind of showing off in your du’aa’.

2. Repentance and turning back to Allaah. Sin is one of the main reasons why du’aa’s are not answered, so the person who is making du’aa’ should hasten to repent and seek forgiveness before he makes du’aa’. Allaah tells us that Nooh (peace be upon him) said: “I said (to them): ‘Ask forgiveness from your Lord, verily, He is Oft-Forgiving; He will send rain to you in abundance, And give you increase in wealth and children, and bestow on you gardens and bestow on you rivers.’ ” [Holy Quran Chapter Nooh 71:10-12]

3. Beseeching, humbling oneself, hoping for Allaah’s reward and fearing His punishment. This is the spirit, essence and purpose of du’aa’. Allaah says (interpretation of the meaning): “Invoke your Lord with humility and in secret. He likes not the aggressors” [Holy Quran Chapter al-A’raaf 7:55].

4. Urgently beseeching and repeating the du’aa’, without getting exasperated or bored; this is achieved by repeating the du’aa’ two or three times. Restricting it to three times is preferable, in accordance with the Sunnah of the Prophet (peace and blessings of Allaah be upon him). Ibn Mas’ood (may Allaah be pleased with him) narrated that the Prophet (peace and blessings of Allaah be upon him) liked to say a du’aa’ three times and ask for forgiveness three times. This was narrated by Abu Dawood and al-Nasaa’i.

5. Making du’aa’ at times of ease, and saying more du’aa’s at times of plenty. The Prophet (peace and blessings of Allaah be upon him) said: “Remember Allaah during times of ease and He will remember you during times of hardship.” Narrated by Ahmad.

6. Seeking to draw closer to Allaah by calling upon Him by His Most Beautiful Names and Sublime Attributes at the beginning of the du’aa’ or at the end. Allaah says (interpretation of the meaning): “And (all) the Most Beautiful Names belong to Allaah, so call on Him by them” [Holy Quran Chapter al-A’raaf 7:180].

7. Choosing the clearest and most concise words and the best of du’aa’s. The best of du’aa’s are the du’aa’s of the Prophet (peace and blessings of Allaah be upon him), but it is permissible to say other words according to the specific needs of a person.

Other aspects of the etiquette of making du’aa’, although they are not waajib (obligatory), are: to face the Qiblah; to make du’aa’ in a state of tahaarah (purity); to start the du’aa’ with praise of Allaah and blessings upon the Prophet (peace and blessings of Allaah be upon him). It is also prescribed to raise the hands when making du’aa’.

One of the things that helps to bring a response to du’aa’ is to seek the best times and places.

Among the best times is the time just before Fajr (dawn), the last third of the night, the last hour of Jumu’ah (Friday), when rain is falling, and between the Adhaan and iqaamah.

Among the best places are mosques in general, and al-Masjid al-Haraam [in Makkah] in particular.

Among the situations in which du’aa’ is more likely to be answered are: when one is mistreated or oppressed, when one is travelling, when one is fasting, when one is in desperate need, and when a Muslim makes du’aa’ for his brother in his absence.

SCTION 3 - DELAYED THE RESPONSE TO DU’AA’

Firstly: Islam encourages us to make a lot of du’aa’, and not to be hasty in seeking a response.  That is because du’aa’ is a great act of worship which is beloved to Allaah. Indeed there are texts which warn us against neglecting du’aa’, because neglecting it is a sign of arrogance. 

Allaah says (interpretation of the meaning): “And your Lord said: ‘Invoke Me [i.e. believe in My Oneness (Islamic Monotheism) and ask Me for anything] I will respond to your (invocation). Verily, those who scorn My worship [i.e. do not invoke Me, and do not believe in My Oneness, (Islamic Monotheism)] they will surely enter Hell in humiliation!’”[Holy Quran Chapter Ghaafir 40:60] 

It was narrated from Abu Hurayrah that the Messenger of Allaah (peace and blessings of Allaah be upon him) said: “(The du’aa’) of any one of you will be answered so long as he is not hasty in seeking a response and does not say, ‘I prayed but I have not had a response.’” Narrated by al-Bukhaari, 5981; Muslim, 2735 

It was narrated from Abu Sa’eed al-Khudri (may Allaah be pleased with him) that the Prophet (peace and blessings of Allaah be upon him) said:  “There is no Muslim who calls upon Allaah with words in which there is no sin or severing of family ties but Allaah will give him one of three things: either He will answer his prayer soon, or He will store it up for him in the Hereafter, or He will remove something bad from him that is equivalent to what he is asking for.” They said, “Then we should make a great amount of du’aa’.” He said, “Allaah is greater.” Narrated by al-Tirmidhi, 3573; classed as saheeh by al-Tirmidhi and others. 

Secondly: The hadeeth mentioned by the questioner is a very weak hadeeth (da’eef jiddan). It was narrated from Jaabir ibn ‘Abd-Allaah (may Allaah be pleased with him) that the Messenger of Allaah (peace and blessings of Allaah be upon him) said: “If a person prays to Allaah and Allaah loves him, He says ‘O Jibreel, meet the need of this slave of Mine, but delay it, for I love to hear his voice.’ If a person prays to Allaah and Allaah hates him, He says, ‘O Jibreel, meet the need of this slave of Mine and give it to him immediately, for I hate to hear his voice.” Narrated by al-Tabaraani in al-Awsat, 8/216. Its isnaad includes Ishaaq ibn ‘Abd-Allaah ibn Abi Farwah, who is matrook as stated in Majma’ al-Zawaa’id, 10/151 

If it is understood that the hadeeth is very weak, it is not fit to be quoted as evidence. 

Thirdly: Undoubtedly if a person feels that Allaah has responded to him, this is a great blessing which deserves that he should give thanks and praise, and continue doing righteous deeds and fearing Allaah, for these are among the greatest means of Allaah answering du’aa’. It is a blessing, if it is true, and a person may feel envious of the one who is blessed in this manner. Every Muslim wishes that his du’aa’ will be answered. This – in sha Allaah – is an indication that a person is righteous, truthful and sincere. So he must continue to fear Allaah, do righteous deeds and avoid haraam things; this will make the blessing continue. Allaah says (interpretation of the meaning): “If you give thanks (by accepting Faith and worshipping none but Allaah), I will give you more (of My Blessings)”[ Holy Quran Chapter Ibraaheem 14:7] 

Fourthly: What the questioner mentions about spreading goodness and da’wah is something that will be good for her in this world and in the Hereafter in sha Allah. This is one of the kinds of kindness that bring good in this world and in the Hereafter. We ask Allaah to support her, guide her and help her in that, and to give her the best reward. 



SECTION 4. FINANCIAL BUSINESS TRANSACTIONS TILTED TOWARDS UNCLEAN ACQUIRING WEALTH:

Primary fraud starts from family setup (guardianship, relatives, ethnic society etc). Allaah has enjoined those who are in charge of children to raise them from when they are very small to obey Allaah and love Islam. Even though they are not accountable because they have not reached puberty, one should not wait until puberty to teach them, guide them and tell them to obey Allaah, because in most cases at that age (i.e. puberty) they will not respond unless they have been brought up in this manner and have learned it from their families since a young age. Hence parents are enjoined to teach young children how to pray from the age of seven and to smack them (lightly) if they do not pray when they are ten. The Sahaabah (companions) used to make their young children fast, so as to get them used to loving Islam and its rituals, so that it would be easy for them to follow its commands and keep away from the things it forbids when they grow up. 

Corruption[1], in our common understanding, is the abuse of trust whereby leaders/workers secretly manipulates approved work procedures and processes for selfish personal gains. Studies have shown that unnecessary secrecy is a common strategy adopted by corrupt people.

Market business men and women are another shady society in financial dealings. Classes of Cheating are not known by many but they were taught through experience in the market forces. 

Back at home in the village or town, house wives play a great deal of shoplifting through periodic household purchases meant for upkeep of the home. Generally or multitude of wives and children are following the head of the family’s actions of deception or looseness in prompt checking of in and out transactions. In the cities, drivers, housemaids etc. under the command of wives are secondary sham activities.

Consuming haraam wealth because they took life is attached to this Dunya.

Logics on this was intended because, we are getting attached to the Dunya or this world more than anything else when:-

1)      We compete with each other for worldly things including politics, games of wealth etc.; thus our thirst for power and glory cannot be quenched.

2)      We fall into depression each time we don’t get what you want like losing positions in politics, game of wealth etc. so that the lives of celebrities/superstars/personalities interests us.

3)      The lifestyle of the rich, politicians etc. impresses us because we want to be the Centre of attention always.

4)      We aren’t ready to displease people to please Allah

5)      We care a lot about what’s in vogue/trend/fashion (We want to belong) because we plan always far and far ahead into the future.

6)      Seeking for Islamic knowledge comes secondary (that’s if it ever comes) after pursuing our future career.

7)      Our friends aren’t always the type that remind us of Allah and His religion.

8)      We regard people as successful according to their status in this world.

9)      We bury the dead yet we don’t learn anything from it. Some people are discussing worldly things even on the grave itself!

10)   We want to ‘make ends meet’ by all means because we are always in a haste to finish our prayer and continue with what we’re doing.

11)   We don’t think that today could be our last day thus; we believe the end of time is still far - far away.

12)   We see things happening to others and we don’t stop to think it could happen to us too because we are solely comforted by luxury (not by the remembrance of Allah).

13)   We don’t plan our time around Salah time so that the whole day or two days pass and we don’t open your Qur’an because we are too ‘busy’.

14)   We care so much about what people say about us because all we care about is how to accumulate more and more wealth?

15)   We argue unnecessarily when we are told something we are used to doing is haram, fraud, corruption etc. so that we keep on delaying good deeds by saying I’ll do it tomorrow, or the next, etc.?

16)   We aren’t able to stop the haram immediately and keep on procrastinating and delay Taubah or repentance because a whole day passes without our thinking of death and grave.

17)   We can afford to waste so much of our time doing things that won’t benefit us in the hereafter. Some people spend Millions of Naira on marriage alone when the Prophet (Sallahu Aalaihi Wasalam) himself spent little on his daughter.

18)   Doing acts of ibadah or worship becomes very difficult for us because we can’t seem to be able to change our extravagant lifestyle despite knowing Allah dislikes the extravagant.

19)   We love visiting the lands of the kuffar, Mushrik, Pagans etc. rather than achieving religions teachings for ourselves and families. Completely forgotten relatives’ problems and rights of kinship in the villages.

20)   We are told about the dangers of consuming Riba or usury or interest yet we argue that this is the only way we can survive in this century. We add that if we find a better halal income we’ll change! Are we teaching what Allah revealed to His Prophets (Sallahu Aalaihi Wasalam)!

21)   We want to live life to the fullest because we care so much about our physical appearance and don’t ask Allah for paradise the way we ask for our dunya or this world.

SECTION 5. CONSUMING HARAAM WEALTH THROUGH CORRUPTION AND FRAUD?

Since corruption has embedded the Nigerian society in the last few years, the Political and Public appointees not only earn the salaries and allowances determined by the Revenue Mobilization and Fiscal Allocation Commission (RMFAC) but huge other ways of embezzlement from public funds.
The Public officers don’t declare their assets and liabilities before taking offices and even they do, a lot of vital information are understated; thus as they stay on with what they acquire many houses and equipment which destabilizes other members of the public and forced them to do the same when opportunity crops in.
Abuse of functions refers to a public employee or public office holder that is doing something which is illegal or something that the official has no legal authority to do, in order to obtain a personal economic benefit or cause an illegal damage to others.
One sort of abuse of office is the misuse of information. That is, if an official, in reliance on information which she/he has acquired by virtue of her/his office, speculates on the basis of this information or acquires a pecuniary interest in any property, transaction or company which might be affected by such action or information or helps another to do any of these actions.
TYPES OF FRAUD PERPETRATED IN A TYPICAL BUSINESS
DESCRIPTION OF SCHEME OF FRAUDS
a)      Any scheme in which a person steals his/her employer’s funds by forging or altering a check on one of the organization’s bank accounts, or steals a cheque the organization has legitimately issued to another payee.
b)      Any scheme in which cash is stolen from an organization before it is recorded on the organization’s books and records.
c)      Any scheme in which a person causes his/her employer to issue a payment by submitting invoices for fictitious goods or services, inflated invoices or invoices for personal purchases.
d)      Any scheme in which an employee makes a claim for reimbursement of fictitious or inflated business expenses.
e)      Any scheme in which cash is stolen from an organization after it has been recorded on the organization’s books and records.
f)       Any scheme in which an employee causes his/her employer to issue a payment by making false claims for compensation.
g)      Any scheme involving theft or misappropriation of non-cash assets such as inventory, information or securities etc.
h)      Any scheme in which Electricity Company and Water Board staff transfer debts from known and favorable customer to innocent/careless customers by adjusting monthly bills. Thus, cash is transferred from one customer to another on the organization’s books and records. The innocent/careless customer is cheated at the expense of favorable ones.
i)       Any scheme in which cash is stolen by Local Government staff from an organization after it has been receipted but understates value in the main sub-treasury receipt.  Thus, recorded low value on the organization’s books and records.
j)       Teaming and lading processes by staff in handling cash. That is an attempt to hide missing funds by delaying the recording of cash receipts in a business’s books
FEW EXAMPLES OF FRAUDS WITH EMPLOYERS
a)      Employee steals blank company Cheques, makes them out to himself/herself or an accomplice.
b)      Employee accepts payment from a customer but does not record the sale.
c)      Employee creates an unknown company and bills employer for nonexistent services.
d)      Employee purchases personal items, submits invoice for payment.
e)      Employee files fraudulent expense report, claiming personal travel, nonexistent meals,
f)       Employee steals cash and Cheques from daily receipts before they can be deposited in the bank. (These may or may not have been recorded on the organization’s books at this point.)
g)      Employee steals outgoing cheque to a vendor, deposits it into his or her own bank account. (Not nearly as likely as the shell company scheme, because the vendor will call to inquire.)
h)      Employee claims overtime, shift hours for unworked hours.
i)       Employee adds ghost employee’s to the payroll.
j)       Employee steals merchandise from warehouse or sales floor.
k)      Employee diverts incoming inventory for personal use etc.
l)       Others: An employee refuses to purchase goods or services from a vendor unless the vendor hires one of the employee’s relatives.
It is extremely difficult, if not impossible, to prevent fraud in which collusion is involved. Also, some of the above scenarios (extortion, bribery, kickbacks, etc.) are less tangible than others and therefore more difficult to detect. It is important to look for unusual changes in an employee’s ‘’lifestyle or standard of living’’. For example, is he/she driving a more expensive car than he/she can afford or than he/she has in the past? Has he/she started buying more expensive clothes or exhibited “affluence” that appears to be beyond what would be expected based on his/her pay? Has he/she been on what seems like an unusually exotic/expensive vacation? Has he/she recently moved his/her children from public to private schools? While certainly not an all-inclusive list, these are all things to watch for if an employee is suspected of wrongdoing.
SECTION 6. ABUSE OF FUNCTIONS/OFFICES
Abuse of functions listed
Causes or actions that are illegal
1.      Blackmail
Blackmail is the crime of threatening to reveal potentially damaging information about a person to the public, a family member, or associates unless a demand made upon the victim is met.
2.      Agent
Person (natural or legal) empowered to act for or represent another person or party.
3.      Breach of Trust
Breach of trust refers to abuse of power, or failure (whether or not such failure was deliberate, dishonest, or negligent) to carry out the general and fiduciary duties of a trustee. Trustees are personally liable for any loss to the trust caused directly or indirectly by the breach, and must hand over (to the trust) any profit made from the breach (whether or not the trust suffered any loss).
4.      Bribery
Bribery occurs during an interaction between two parties. Both the giving and the receiving party of the bribe commit a crime.
5.      Cartel
A cartel is an agreement (formal or informal) among competing companies to coordinate prices, marketing and production. Cartel members may agree such matters as price fixing, total industry output, market shares, allocation of customers, allocation of on territories, bid rigging, establishment of common sales agencies, and the division of profits or combination of these. The aim of such collusion is to increase individual members' profits by reducing competition.
6.      Collusion
Collusion is an agreement, usually secretive, which occurs between two or more persons to limit open competition by deceiving, misleading, or defrauding others of their legal rights, or to obtain an objective forbidden by law typically by defrauding or gaining an unfair advantage. It can involve an agreement among companies to divide the market, set prices, or limit production.
7.      Cronyism:
Cronyism is a form of favoritism shown to close friends. A typical situation of cronyism would be the political appointment to office of a friend without regard for her/his qualifications.
8.      Debarment/Blacklisting
Debarment/blacklisting entails the exclusion from public contracting including public procurements.
9.      Deception
Deception is an act to propagate beliefs that are untrue or not the whole truth (as in a half-truth or omission).
10.   Embezzlement
Embezzlement is the fraudulent appropriation of money or property by a person entrusted to safeguard the assets in another's interests. Embezzlement can be committed by a person entrusted with private or public resources.
11.   Extortion
Extortion is the unlawful use of one's position or office to obtain money through coercion or threats. One example would be when customs officials request undue 'customs duties' from importers as a condition to clear their goods.
12.   Facilitation Payments
Facilitation payments are a form of bribery made with the purpose of expediting or facilitating the performance by a public official of a routine governmental action and not to obtain or retain business or any other undue advantage.
13.   Fraud
Fraud is a criminal offence in most jurisdictions. It involves the use of deception, trickery and breach of confidence to gain some unfair or dishonest advantage.
14.   Kickbacks
A kickback is a bribe to obtain an undue advantage, where a portion of the undue advantage is 'kicked back' to the person who gave or is supposed to give the undue advantage. The payment of kickbacks is a corrupt practice which typically occurs in connection with a public procurement process when a company pays a procurement officer to illegally award the contract to the company in return for a bribe.
15.   Leniency
Leniency for participation in a crime is a blanket term covering either immunity from prosecution (dismissal of all charges) or reduction of penalties. Immunity from prosecution means that no charge is brought at all, i.e. the undertaking or person concerned is not punished at all for having participated in the crime. Reduction of penalties means that the penalty levied against the undertaking or person concerned is reduced (e.g. in the case of a company self-reporting bribery).
16.   Nepotism
Nepotism is a form of favouritism shown to family members without regard to merit.
An example of nepotism is the appointment of family members to civil service, often at the expense of a more qualified person.
17.   Patronage
Patronage is a system in which political supporters are rewarded for their support, such as by being appointed to public office or receiving contracts, subsidies or other benefits.
18.   Price Fixing
Price fixing is an agreement between participants on the same side in a market to buy or sell a product, service, or commodity at a fixed price, or to maintain the market conditions so that the price is maintained at a given level by controlling supply and demand. The purpose of price fixing is to coordinate pricing for mutual benefit of the traders. The group of 'market shapers' involved in price fixing is sometimes referred to as a cartel.
19, Supply Side/Active Bribery

'The promise, offering or giving, to a public official, directly or indirectly, of an undue advantage, for the official himself or herself or another person or entity, in order that the official act or refrain from acting in the exercise of his or her official duties.' The typical forms of supply side bribery, apart from direct payments, are: 1) Gifts and travels  2) Various donations and contributions to political parties
20.   Undue Advantages
Refers to something to which the company or person concerned was not clearly or legally entitled, such as an operating permit for a factory which fails to meet statutory requirements.
21.   Conflict of Interest
An employee, manager or executive has an undisclosed economic or personal interest in a transaction that adversely affects the company results. Again an employee owns an undisclosed interest in a supplier. The employee negotiates a contract between his employer and the supplier, purchasing materials at an inflated price.
